Does forming a Pvt Ltd on rented property without the consent of landlord amounts to deemed sub-let?

• Property is rented out to Mr. A

• Mr. A formed a Pvt Ltd company on that rented property and started paying rent from the company's books

• Mr. A is one of the director in the formed company

• Mr. A has not obtained any consent from the landlord regarding forming Pvt Ltd company on that rented property.


Does is amounts to sub-let of the rented property?

First of all whether sublet was allowed in the rent agreement. If not then it will be better to have a NOC from the landlord.
Sub-let was not allowed in the rent agreement, and Landlord hasn't given any NOC to the Tenant.

Would it be deemed sub-let?
I don't think there is anything as deemed sublease.
The landlord has all rights to take legal action

yes it is unauthorized deemed sub-let
