Disqualification of directors under section 274(1)(g)

Can anyone please explain the applicability of sec. 274(1)(g) of the Companies Act, 1956 to a private limited company?

Dear Palak,

 

Section 274(1)(g) is applicable only to public companies and not to private companies. That is to say, if a person was a director of a public company, which defaulted as per the clauses given under that section, then he cannot be appointed as a director of a PUBLIC Company.

 

Hence, he can be appointed as a director of a Pvt. Ltd Company

Dear Palak...if you are talking about declaration by Director regarding 274(1)(g) then it is applicable....and

if you are asking whether a prviate company will be counted for 274 (1)(g) then Mr. Ankit is absolutely rite
