First of all as per section 17(5) of GST you cannot take the GST credit of property that used for own purpose.
and second after the OC taken by the builder on property then there is no liability of GST arise and it will include in your cost of the property.

I had purchased gaothan flat in 2015 ready to move in flat in Vashi Navi Mumbai before GST.
I had an MOU signed with Builder..
Stamp duty registration haven't done due to financial issue and now i am planning to sell it.
The buyer has sought loan from Finance company and the loan may disburse into Builders account.
The buyer will perform and pay stampduty registration appropriately.
Trust no 12% GST will be apply for above scenario since the flat was ready to move in and just that ownership has been changed for old flat.
Since its Gaothan Grampanchayat flat..there is no CC / OC for the Flat/property.
Pls help and guide.
