Group health insurance premium not deductible u/s 80d

215 views 1 replies

I am contributing 100% premium to the group health insurance which is deducted directly from my salary by my employer. The employer pays the premium to the insurer. I am told by the company CA that I cannot claim deduction under 80 D for the premium deducted from my salary which is clearly shown in my payslip since it is the company which pays the premium. Can anyone please advise if I can get this deduction since the section mentions that one can claim deduction unless the premium is paid in cash?

Any advice will be highly appreciated. Thanks again

If Premium Paid Certificate is in your name than u can claim deduction because it is deducted from your taxable income. For the Purpose of Deduction Section 80 (2B) states that payment shall be made by

(i) any mode including cash in respect of any sum paid on account of preventive health checkup.

(ii) any mode other than cash in all other cases not falling under (i).

But Important thing is that it should be included in form no 16 and premium paid certificate is in your name.
