Deposit of TCS or TDS

If a supplier from whom we are purchasing goods has charged TCS in his invoice on us , but we have not made the payment against that invoice , then is the supplier justified in not depositing the TCS in the Govt's treasury ?

Yes. it's justified. Coz tcs is payable to government on payment basis... i.e when buyer pays to seller , only then seller pays to government.
