Defective notice 139 (9)

Hi All,

One of my client has recieved notice for defective return showing error as 'Balance Sheet and Profit and Loss A/c has not been filled'.

 

Company doesnot have any income and not liable to maintain accounts u/s 44AA. 

 

Kindly guide on the same asap.

If you have declared your income in business head. You have to fill details of B/S & P&L.

No I haven't declare any income. It is a NIL return

Which ITR form you filed?
Which business code select by You?
Nil return means what....?

I have filed ITR 6, Business code - 0703 - Consultancy Service , NIL return means there is no business activity.

I haven't declare any income in Business head.

Firstly no nil return filing is needed in IT return.

Secondly you show business in your return even income is nil you have cash balance & you have to show in Balance sheet.

It is required for companies to file balance sheets and profit and loss even if no income. You can upload the new xml file by login to your account under the tab filing for defective return. The time limit as per section 139(9) is 15 days.
