Deduction of TDS

Dear sir,

We are paying professional fees to a personal who is not a residence of India. they have provide the service in India. can we deduct the TDS on their professional fees.

yes income chargeable to tax u/s 5 , sec 195 is attracted , TDS has to be deducted u/s 194J
