Declaration for SSI Exemption

Hi all,

My question relates to one of procedural aspect.  If a unit has turnover of less than Rs. 150 Lacs for the financial year, 2005-07, then it could claim exemption of SSI as per notification 8/2001.

To avail full exemption from duty, whether there is any need to file declaration as required in Notification 36/2001.  A plain reading of it says that if exemption is based on value then declaration need not be filed. I dont know if there has been any change in rules thereafter.

So please help as to whether it is statutory requirement to file declaration for claiming SSI exemption upto Rs. 150 lacs of turnover.

Hi,

The requirement is that once the turnover (excluding Sales tax & Export ) reaches 90 lakh, a declaration is required to be filed in Annexture 4 and must not forget to obtain a  dated acknowledgment otherwise it can "cost" you.

Dear Mr Acharya, Notification no. 36/2001 prescribe a limit (expemtion limit - 10 lacs)for Home Clearence (domestic sale, not export sales), on crossing of which it is mandatory to obtain a declarant code no from Central Excise Division and file annual declaration. This notification was latest amended by notification no. CE-14/2005 (NT), and the prescribed limit is Exemption Limit - sixty lacs Rs. That means Rs 150.00 lacs - 60.00 lacs = Rs 90.00 lacs. So if a SSI unit sales for domestic market crossed Rs 90.00 lacs in a year, it is mandatory for them to file declaration.

 I have crossed sa;les of 90 lacs. But as I avail exemption under 03/2005 for certain products,my excisable goods sale stands at 60 lacs.

No. You need to file declaration when value of excisable goods reaches 90L.

we have two units, in one unit we have filed declaration u/s 8/02003 for SSI exemption and in second unit we have not given the declaraion and we have availed cenvat credit. Is it possible now to get exemption for the second unit in mid of the year, we have not crossed 70lacs

No. Once the cenvat/duty payment route is choosen, it cant be changed in the middle of the year.
