Date of purchase for property sale to calculate CG

Hello Friends,

I have sold residential flat / property as per the details below, appreciate if you could help me with which date to be considered as a date of purchase while filling ITR2 Schedule - Capital Gain.

Registration/Agreement: 24/12/2014    

Provisional Possession: 30/03/2016  - here 100% amount of the property paid to the builder.

Completion cert: 09/09/2020 - due to environment clearance issue completion certificate was delayed by municipal corporation
Final possession: 01/10/2020

Property sold 31/03/2021

Date of allotment of flat will be date for capital gain

By date of allotment did you mean registration / agreement date or provisional possession date please?

Not registration,.  When developer gives a letter of allotment stating flat no.etc...or if in your case  provisional  possession may be if in such letter , developer states flat alloted to u

Developer gives allotment letter & it is different from possession letter and registration.

Somewhere allotment must be stated

 

No separate allotment letter was issued by the builder however after paying 20% of the property value the flat number was allotted and agreement was done, should I consider the agreement date as date of purchase? Also is it necessary to complete 100% payment of the property to be considered as purchase date?

Registration/Agreement are two different things. Registration is at registrar office and agreement is at builder level. In this date of possession when you paid 100% payment is to be taken into account. Since in many societies registration at registrar office is either not done due to technical reasons or is done very late by builder. It appears in your case your registration is still pending.

After the flat allotment registration at registrar office and agreement with builder was done at the same time in Dec 2014

No builder will register a flat at registrar office on 20% payment. Please check again. But if it's correct then  Dec 2014 is purchase date.

This is a common practice in Pune, will go with Dec 2014 as purchase date then. Thank you for your help.
