Customs on Software if received via Internet

Hi

 

I would like to know if customs is applied to software that is received via Internet (Downloaded from a website or email) from abroad and payment is made via wire transfer.

 

If not customs which tax is applicable

IN PRESENT , THIS FACILITY IS PROVIDING BY THE STPI UNIT.

We are  a mumbai based company wanting to import the software throught internet and have to send the payment by wire transfer from bank. Our questions:-

1. Is there any custom duty payable. If yes than how much.

2. What is the procedure to make the payment through bank.

3. We are a small scale company, to go through STPI will cost us lot of money, can we do it from our own office??

4. We are going to import educational software for kids.

If anybody out there can provide me information, it will be most helpful to us.

Where imports are made in non-physical form, i.e., software or data through internet / datacom channels and drawings and designs through e-mail/fax, a certificate from a Chartered Accountant that the software / data / drawing/ design has been received by the importer, may be obtained.

AD bank should advise importers to keep Customs Authorities informed of the imports made by them under this clause.
