Creation of post of Chairman, COO and CEO are internal process of the Company.  At present, law does not regulate creation and maintenance of any of these posts in any company.

Thus, creation of such posts will depend on your Company Board Meeting resolutions only.

Just passed a B.R and give them this designation also. No just legal formality or form filling is required.

 in india there is no regulation to creat the post of the CFO ceo so through only pass a board resolution the company can crerat the post

Yes.

There is no separate legal requirements for public companies also.
