PROCEDURE FOR CONDONATION OF DELAY
FIRST OF ALL FOR SATISFACTION OF CHARGE, FILE FORM CHG 4 WITH ADDITIONAL FEES. THE CHALLAN FILL SHOW THAT FORM HAS BEEN FILED DELAYED AND YOU HAVE TO GO FOR CONDONATION OF DELAY
PASS THE BOARD RESSOLUTION IN BOARD MEETING AUTHORISING DIRECTOR TO SIGN ALL THE PETITION , AFFIDAVIT ON BEHLF OF COMPANY FOR PURPOSE OF CONDONATION OF DELAY. AND ALSO PASS THE BOARD RESSOLUTION FOR AUTHORISING ANY PRACTISING PROFESSIONAL FOR ATTENDING THE HEARING.
FILE FORM CHG 8 TO RD ALONG WITH THE FOLLOWING ATTACHMENTS
AFFIDAVIT BY THE DIRECTOR OF THE COMPANY
PETITION
COPY OF BOARD RESOLUTION FOR CONDONATION OF DELAY
CHALLAN OF FORM CHG 4
COPY OF NOC FROM BANKS
FORM CHG 4 FOR SATISFACTION OF CHARGE
WITHIN 30 DAYS FROM THE FILING OF THE ABOVE FORM CHG 8, RD WILL GIVE THE REASONABLE OPPERTTUNITY OF BEING HEARD TO THE PETITIONER AND FIX THE TIME FOR HEARING AND WILL IMPOSE PENALITY IF ANY AND FINALLY WILL PASS THE ORDER.

Further I have already filed CHG-4 and then I received a notice of 35 days delay, therefore, as you described

Superb for all your information. thank you sir. i have one more doubt here kindly, solve sir. question is : there is one private company, it is going for striking off , before the striking off all the needs to be cleared. the company has paid all its debts but couldn't file the CHG-4 within the period of 30 days. the charges are remained open 3 (Charges : 2008 is 1, 1996 is 2 ) according to MCA site. so, now my question is can file one CHG-8 for all three (3) Charges or to file CHG-8 separately for each charges. please answer.

Email id : bhavikvd @ gmail.com In my private limited company I had taken loan of 24 lakhs in 2002 and repaid full amount by Feb 2006 as per their schedule. but after repaying the amount old directors didn't fill form 8 and 17 in 30 days. we have document of No Due Certificate from that financial institute as well as other pertaining documents. Now problem is that on MCA site it still appears that loan is not satisfied. we need to do some financial transaction which is kept on hold because of this problem. please help in detail. how to go about and what penalty charges will be levied.
