Conditions for being in Merit List

My Doubt was that, if I get exemption in a subject or two, in suppose November attempt but do not clear any group, such marks would be carried forward in my next attempt and if i pass both groups in May Attempt (with good marks), would i be eligible for Merit List? Few people told me that if u want to b in merit List u'll have to clear both groups at once without any carried forward exemption marks. Kindly Clarify.
