The Companies Act, 2013 primarily governs the incorporation, functioning, and management of companies in India. It lays down various provisions related to company names, business activities, and compliance requirements. However, it does not explicitly prohibit a company in the construction industry from using terms like "metal industries" in its name.

As per the Companies Act, 2013, there is no specific provision that restricts a company's business activities from being different from what its name might suggest. The key compliance requirement is that the company's main object, as stated in its Memorandum of Association (MOA), should accurately reflect its actual business activities. If ABC Metal Industries Pvt Ltd. is wholly into construction, it should ensure that "construction" is included as one of its main objects in the Memorandum of Association (MOA). If not, the company may need to file an application with the Registrar of Companies (ROC) to alter its objects clause. Additionally, if the name is perceived as misleading, stakeholders or regulators could raise concerns, but it is not an automatic violation unless it is found to be intentionally deceptive or fraudulent. It is advisable to review the MOA and consider aligning the name with the business for greater clarity and transparency. At this point, consulting a business registration specialist like Setindiabiz, can help you choose a name that complies with the MCA's name guidelines specified for businesses.

No, there is no violation of the Companies Act, 2013. As per section 4(2) of the Companies ACt, the name of the company shall not be misleading or gives false information. There is no violation if the main objects of the Company includes construction/ infrastructure/civil works. If it is alligned with main object then there is the problem
