Complete confusion in C Form and Road Permit (way bill)

Please accept my apologies if these query have been answered earlier -

We are computer dealers and started our business in 2007, soon after I graduated. Having no idea about C Form, VAT, Road Permit (WayBill) etc. I was completely dependent on my tax consultant, who I dont blame or have any prejudice against although everything was prepared by me - list of purchase and sales , he did deliver the C Forms and Road Permits to us. Of late he became very slow - now we have C Forms pending since 2008 and we need to give them to our suppliers. We were issued road permits long time back - 2008 and unfortunately they expire in 90 days, considering at that time we did not get any C Form and had only road permit, we did not use the road permits. (the road permit file is missing from our office and an FIR for the same has been lodged)

Now the confusion is that , we have paid all tax - VAT upto date on our sales, just that now when we are asking for C Form the tax consultant has provided us with a form - in which the details of purchase has to be put - viz. Date/ Bill No./Amount etc. which is similar to a purchase ledger and he says that this has to be provided to the tax authorities and then and then only would they issue C Forms, also note - there material has been procured without the road permits. I am in a total mess - i dont know how to sort this thing out. Please help - I agree to be completely wrong - how do i get out of this... considering the incompetence of my tax consultant i am considering - finishing all accounts with him till the last financial year 2009-10 and starting with a better tax practitioner

Also note - that i am worried that now the tax authorities would question as to how material was brought into the state without the presance of road permits.!! Please help me resolve my confusion

1) make a list of C form required by you a) quarter wise and supplier wise, i.e you have to deliver one form to one supplier in a quarter, not using waybill is not an offence, provided you have transport documents and their payment vouchers, also you have invoice copies on which checkpost stamp would be present.

2) waybill is an instrument which is issued prior to entry of goods in state, and it is not required on certain classification of goods and certain amounts, for which every state has own guidelines,

3) As mentioned by you, you have cleared all taxes, then you must have sumitted periodic returns of VAT as well as CST returns, in which you had mentioned the "central purchase"

4) mere not using the waybill is not enough to deny form C, but the officer would call back the documents to rely that materials were actually purchased from out of state, counter documents are a) consignment note b) bank payment documents c) supplier's invoice d) octorai ( if applicable) bills,

5) above all, the purchases in your vat returns would confirm the central purchase for which you are asking the forms, so after some verification ( may be an inspection initiated by department) you would get the forms.

Can u pls check the following (maybe we will have similar consignments from other vendors also)

These items are being sent on returnable basis.

In some states there is another form but just check what is applicable in AP.

There is some special form used for the purspose

There is no tax payable on such items but it has to be proved that the material went out

i dont have the invoice copies which have been stampped at the cheakpost!

the whole bundle of road permits have been dropped by a careless employee of mine while travelling - FIR copy of the same is with me! but the issue is that we used had last issues road permits at 2008 - we have been getting material w.o. road permit even after that - i am in utter mess - please help and suggest best method to get my self work in order!
