A petition for condonation of delay needs to be filed under section 141 of the Companies Act with the Company Law Board.

The power for condonation of delay has been delegated to ROC. Circular from MCA Attached

my query is not that, i know that we need to file a petition with CLB. do we need to get report from Roc.
No. Even in the past when petition was filed with CLB no such ROC report was required. U do not require any such report
