Cess On Paper (Code No 00380072)
We are the paper Mfg co and in Excise special cess (i.e paper cess ) is applicable to Paper Industry.
As per rule 3(4) of cenvat credit Rules 2004,provide that cenvat credit ( include BED Credit) may be utilized for the payment of any duty of excise. Cess on paper (code no 00380072) is a duty of excise as per statutory provision.If we are utilized the cenvat credit include (BED/CED) for payment of paper cess is legally correct or not ? if it is coorect then reply with any case law,if available ?
