Cenvat credit of service tax paid on flat purchased

Hi,

An assessee has paid service tax to builder while purchasing a flat. He intends to use it as an office. He wants to treat it as capital goods and claim cenvat credit of 50%. 

In my view residential flat, even if used for business is not included in definition of capital goods. Please share your views.

if treat as business the name is land and building .,

its not allowed for service tax credit
