Hello. One of my client sale a property in 2008 on allotment agreement and give possession to the buyer. Buyer has not paid stamp duty in 2008 and property in the name of Seller. Now Seller has paid the stamp duty in March-2019 and register their name in property. My questions is that for seller what is the year calculate for capital gain 2008 or 2019? Seller has purchase property in 2000 of Rs. 125000/- and sale in 2008 of Rs. 800000/-

in my opinion year of sale will be reckoned as 2019 unless you prove that actual sales has been effected in the year 2008 itself
For 2008, Payment of cheque payment and allotment agreement has been made.
