Can they SUDDENLY prosecute??

my wife has received a tax demand notice from CPC but the demand is wrong. So she is trying to raise grievance and rectification requests and explain why she is correct and demand is wrong.

while this is resolved, CAN THEY SUDDENLY PROSECUTE her without notice and put a court case against her for delayed payment of demand? or will they atleast give further notices??

Prosecution is the last resort. even for prosecution, you'll get an opportunity to be heard to submit your reply before launching prosecution. so do not worry
Do the rectification or revised ITR.The demand may get nullified if it is wrong .

CPC Communication is for knowing status of ITR Processed.Now it's your turn respond to it .

If you agree for demand then only you have to pay.Else you can submit disagree response
