Bifurcate salary in basic & hra for some employees only

Hello Everybody,

Here I am in a dilemma, need your guidance on the same. I have few employees who have high salary & under the liability of TDS but they can save if I bifurcate their salary in Basic & HRA, but I do so then I need to deduct ESIC & PF for  employees who have less salary around 17K to 18K.

Is it legal for a company to bifurcate salary of a few employees only?

Salary for different categories of employees shall be different but the salary structure should be one and the same for all the employees under one organisation. It is particular that salary structure of one category of employees should not be different.

Thanks for the response but "Salary for different categories of employees", what is the meaning of categories here? Did you mean profiles/designation or amount of salary?

 

i meant to say for eg in finance you are paying 2 employees salary of 50000 Per Month than break up of both cannot be different.

But for employee in like advertising and finance can have different structure
