Ay 2020-21 ITR DEFECTIVE
Dear Experts, I file itr 3 A. Y 2020-21. Tailoring income gross receipts 611853 and net profit 281453/- other source 21139/- total income 302590/- income tax status show itr filed is defective. Response notice 139(9) error code 1021. Errors descripttion.. Taxpayer is offering income under head business or profession. Hence as per prov. Of sec. 44AA THE TAXPAYER IS REQUIRE TO MAINTAIN BOOKS OF ACCOUNTS. HOWEVER AS SEEN THE TAXPAYER NOT FILL UP. PLS SUGGEST. CAN I FILL AGREE WITH DEFECT AND UPLOAD ITR AGAIN WITH 44AD PLS SUGGEST ME.

Yes u can revise return and file under 44AD
Yes should post a grievance on e-nivaran
You can't file return u/s 44AD/44ADA as it is not a specified profession as per 44AA. tailoring is a profession not a business and it is not a specified profession as per 44AA hence you can't.
Can I change ITR form in reply to defective return ? Means in reply to Defective Return of ITR 3, Can I file ITR 4 in reply ? Means without choosing Return Revision option can I upload revised XML (ITR 4 XML) in reply to Defective Return ?

If you want file ITR 4 for professional income, it should be specified profession as per sec 44AA(1).and tailoring is not a specified profession as per the act so you can't file ITR 4.

Dear Exparts, I File ITR 3 in Offline mode and shows validation is successful. But at the time of submission of Return one error shows that "In schedule BP sum of values entered from 36(iv) to 36(vii) should be equal to sum of Net Profit declare at Sl.No. 64(id) and 64(iid) in Sch P&L". I declare only professional income of Rs.60,000/- for F.Y 2020-21 which is not require books of account. It is not presumptive or speculative income. How I solve this type of error.
