NO U CAN NOT TAKE TRANSFER IF U R IN LAST YEAR OF ARTICLESHIP

& SECONDMENT IS TO REGISTER WITH ONE CA & TO WORK WITH OTHER CA.

any relaxation on new t/f rules???????

what is Misconduct involving moral turpitude:
as per new rules?????

 Moral turpitude includes the following:

   (1)  That element of personal misconduct in the private and social duties which a person owes to his fellow human beings or to society in general, which characterizes the act done as an act of baseness, vileness or depravity, and contrary to the accepted and customary rule of right and duty between two human beings.

   (2)  Conduct done knowingly contrary to justice, honesty or good morals.

   (3)  Intentional, knowing or reckless conduct causing bodily injury to another or intentional, knowing or reckless conduct which, by physical menace, puts another in fear of imminent serious bodily injury

hi everyone..

i need some urgent advice... so here goes

like gautam i hv already completed 2 yrs 3mnths of articleship and taken termination on 31 march 2009.. then i got busy with my bcom final exams n hence dint send t form right away..later in may i found out about t new rules against transfer... i have been waiting for some relaxation since then but now i m most certain its not gonna happen.. t nov attempt is coming closer n i m stuck with no one to sign my form.. what should i do?? can i send only form 109 for registeration of termination and wait for some miracle??

you are now in real jeopardy. & it looks like there is no way except one.

you can do one thing , request your previous ca to again take you back as article assistant and consider lapse period of articleship as if you are doing it.

I know it is difficult , but right now this is the only way out for your solution.

but my old principal wont take me back.. he is a real sadist!! i hav to give my 2nd attempt of pcc in nov 09... after going through t new notification i am thinking of switching over to ipcc for t may 2010 as i will get benefit of the 2yrs 3mnths of articleship already done by me... but cant decide!!!

also can somebody pls tell me what proof of relocation to another city will be considered valid under t 2nd clause??

 hi antima , i think u may decide one again becoz laxmikant is truely right that is only one way to solve your problem.so, please try againg with your previous CA and focus on study.

friends please take a look over this case.

one of my friends is an article under a CA where the principal's son is also an article.his son went abroad for tour for 2 months.then he went for coaching in a metro city for nearly 6 months.but in his attendance sheet only  1 week leave has been put.whereas, one of the students went for coaching in the same metro city.now that particular student is undergoing the last year of articleship.but now the principal is insisting that the student has taken excess leave and should undergo supplementary articleship.the student asked for credit for extra time worked.the reply of the principal was that "we dont count such overtime in the case of students." please see friends.two students under the same principal has two type of rules.why coldnt ICAI take a look over theses kind of discriminations.the status of the son of the principal is that of a deemed dummy.why uttam prakash is not considering this.are the rules of ICAI regarding students not applicable to  relatives of the members?
