We are paying Listing Fees to Future Retail Ltd for Listing of Some FMCG products, Future Retail has Given Tax Invoice without Service Tax saying that Service Tax is not aplicable on the Listing Fees.
Kindly guide me for the same.

Applicability of service tax on listing fees paid

As per clause (g) of Sec 66D(Negative list of services) ,selling of space for advertisements in print media is a negative service.
Product listing service is as good as selling space for advertisement and thus chargeable to ST.
Since, as per Sec 68(1) of FA,1994 -the liabity to pay tax is of service provider , you as a service receiver need not to worry.
