A returning nri wants to start a company. needing guidance.

Dear all,

 

I am needing an advice. I am living outside India since last 8 years and now planning to come back to home. I am thinking to start a manufacturing unit with my savings. I am planning to start either Pvt Ltd / LLP depending upon the ease of procedures and filing requirements. However, despite google search, I am struggling to get a clear picture on certain aspects for starting the company . As I will be investing my hard earned savings, I want to know few things. Hope you can guide me.

 

a) Can I start a company in India?

b) Will I be considered as NRI even after I am returning for good?

c) Do I need to have Indian Resident as a director / partner in my Startup?

d) The amount I will be investing in my Startup, will it be termed as FDI? Do I need to take approval from RBI?

e) Can I give loan to my Startup?

f) Are there any special provisions for returning NRIs who want to start a business?

Dear all,

I won't mind paying professional fees if someone is knowledgable enough to answer these questions. I would have been much happier with someone giving a reply mentioning that these questions will be replied with XYZ fees ...

Somehow I am loosing my faith in Indian business environment with facing so many twists and turns with nobody showing a clear direction. Slowly having a feeling that it is better to start a business abroad as by now, I would have been running it, unlike currenly struggling with the procedures and rules and blind spots !!!!

Still keeping hopes alive.
