54 EC Capital gain bonds

Hello,

Inherited property sold.  Trying to get FMV as on April  1, 2001. If the seller invests an amount greater than the capital gain will there be any issues? Need to invest before the 6 month period.  Are these bonds available throughout the year?

Thanks
