Hello Everybody,

I have deducted 2% of TDS under 194C of an agent made contract for once in an year,

This commission is paid against the room Nights provided by the agent to our hotel.

Now Sec.194C says that "any type of Service other than Proffessional Service can be deducted under 194C".

Based on the above clause I have deducted the TDS.

So my question or dought is if this is correct or Not

If it is not Can anybody please explain basing on the sections. Please.

In this case,You need to 5% TDS Deduct Commission/Brokerage – Section 194H. The Rate of TDS has been  5% in Budget 2016.

But recent amendment say it is 10% can you please explain in detail with the sections you have used for this case.

No deduction shall be made under this section in a case where the amount or the aggregate amounts of such income to be credited or paid during the financial year does not exceed INR 15,000.

TDS on Commission/Brokerage – Section 194H. The Rate of TDS has been reduced from 10% to 5% in Budget 2016. This revised rate would be applicable from Financial Year 2016-17..
