sir there is a bill for payment of professional fee with rs.50,000/- and out of pocket expenses rs.600/- .as per tds 194j rule tds to be deducted on the fee excluding out of pocket expenses but they have deducted on 50,600/-.. in rule out of pocket expenses are not allowed for tds if it reimbursed but in bill there is no clarity regarding outof pocket expenses reimbursed or not...so in which amount shall we required to deduct as per law...help me..

No other option but to claim TDS in ITR. May be for you the profession fees charged remains 50K

Hi,

if Bill is inclusive of both professional fee and out of pocket expenses, then obviously both of them will applicable for tds provisions, on flipside if out of pocket expenses are collected separately with bills then tds will not be applicable
