Section - 1 - Short title and extent

EMPLOYERS' LIABILITY ACT, 1938

[REPEALED BY REPEALING AND AMENDING ACT, 2016]

An act to declare that certain defences shall not be raised in suits for damages [***] in respect of injuries sustained by workmen.

Whereas it is expedient to declare that certain defences shall not be raised in suits for damages [***] in respect of injuries sustained by workmen;

It is hereby enacted as follows:-

Short title and extent.

1. (1) This Act may be called the Employers' Liability Act, 1938.

(2) It extends to the whole of India [***].


1. The words "in the Provinces" omitted by A.O. 1950.

2. The words "except the State of Jammu and Kashmir" omitted by the Central Labour Laws (Extension to Jammu and Kashmir) Act, 1970. These words were earlier substituted for "except Part B States" by the Part B States (Laws) Act, 1951.
