Practice by non-registered patent agents.123.
If any person contravenes the provisions of section 129, [he shall be liable to penalty, which may extend to five lakh rupees, and in case of the continuing default, a further penalty of one thousand rupees for every day after the first during which such default continues].
1. Substituted for "he shall be punishable with fine which may extend to one lakh rupees in the case of a first offence and five lakh rupees in the case of a second or subsequent offence" by the Jan Vishwas (Amendment of Provisions) Act, 2023, w.e.f. a date yet to be notified. Prior to its substitution, said words were amended by the Patents (Amendment) Act, 2002, w.e.f. 20-5-2003 and the Patents (Amendment) Act, 2005, w.r.e.f. 1-1-2005.
