Section - 61 - Reference of conciliation in enactments
PART IIICONCILIATION[Reference of conciliation in enactments.61. (1) Any provision, in any other enactment for the time being in force, providing for resolution of disputes through conciliation in accordance with the provisions of this Act, shall be construed as reference to mediation as provided under the Mediation Act, 2023.(2) Conciliation as provided under this Act and the Code of Civil Procedure, 1908 (5 of 1908), shall be construed as mediation referred to in clause (h) of section 3 of the Mediation Act, 2023.]
1. Substituted by the Mediation Act, 2023, with effect from a date yet to be notified. Prior to its substitution, section 61 read as under :"61. Application and scope.-(1) Save as otherwise provided by any law for the time being in force and unless the parties have otherwise agreed, this Part shall apply to conciliation of disputes arising out of legal relationship, whether contractual or not and to all proceedings relating thereto.(2) This part shall not apply where by virtue of any law for the time being in force certain disputes may not be submitted to conciliation."
