whether excess leave apply?

hi

one of my friend had completed his 3yrs of articleship training. He is worring about whether any excess leave will apply to him.
Actually he first joined a firm and worked there for 354 days and took 14 days leave in that 354 days. Thereafter he took termination and joined another firm for the balance period and there he took 126 days leave and  completed his articleship. Aggregate of leave days accounts to 140 days and he mentioned that in the forms which he submitted to the institute.

Whether any excess leave apply to him?

As per my knowledge on termination leave eligibility at previous employer does not remains available. Therefore 23 days of excess leave will apply at present employer, But also wait for other Members opinion.

@ Karunakar ur friend need not worry abt leave as per the Institute regulations total leave that are allowed in 3 years articlship period is 1/6 th of the actual period served (excluding leaves taken).

 

So in ur case excess leave if any will be calculated as follows as per Training regulations of the Inst :

 

 

Total no of days served 1095
Less total no of leaves taken 140
   
Actual period served 955
   
Entitlement of leave (1/6 th of the actual period served) 159
   
Excess Leave -19

So Relax buddy and i don't think any excess leave is there in ur case.


My case was also almost same as urs i have submitted my form 108 only yest i took an aggregate of 134 days  of leave from different principals.
