Procedure for the purposes for sending the legal notice:-
As such, there is no fixed procedure but it is to be noted that:-
- A notice has to be meticulously drafted because once sent it cannot be edited.
- A notice after completion of drafting should bear the sign of the sender (lawyer of the person himself).
- Notice is to be sent via post to the other person usually the preferred mode is RPAD.
- A copy of the receipt is to be kept in your possession as evidence that your demand has been communicated to you by the legal notice to the other party.
- Different laws have different period of limitation for sending a notice. For example, when it comes to the negotiable instruments act,1881 the period of limitation is 30 days from the date on which the cheque has bounced. Further Section 80 of the Civil Procedure Code 1908 states that no suit can be filed against the government without sending a proper notice. Thus you have to be quite careful with legal notices.

To send a legal notice has become fairly easy for a layperson as many samples are available on various websites, but it is still recommended to avail the services of a professional. One can also opt for legal advice online to serve a legal notice. A lawyer's notice would create a strong impression on the opposite party, and all the legal angles and provisions will be taken care of. Sending a well-drafted notice is like winning the half-court battle.
The sender can approach an attorney and discuss their case with them. Post discussion, the drafting of the legal notice is initiated, which contains all the material facts of the case, cause of action, grievances of the sender, and other relevant information. A legal notice should always be sent on the letterhead of the lawyer through a registered post or online. After sending the notice, the defendant is given a reasonable time to reply to a legal notice. Due to the long judicial process in our country, it is always advisable to settle the matter out of court amicably and avoid court litigation.
