Introduction

Improperly organized and/or aimless society, may lead to distraction of knowledge, perversion and going back to olden days. In simple history will repeat. Even if such society may have strong economic capabilities, still it will not go forward unless it is organized in proper manner.

Need for classification

Everyone deserves appropriate return for every activity they do. People do some activity for money. At the same time if some people do any activity for greater good of large number of people without considering any self benefits, then these people too deserves appropriate return. Such return may be respect/identity for what they are doing for the people. If such return is not allotted to them, then no one considers humanity but self benefits. Following are pinpoints preferring classifications To secure and encourage humanity and get governance for efforts made honestly. To become an enlightened society. To excel the progress of human knowledge and increase the human capabilities. To be aware of what was the role of each human in the society. Basis of Classification and underlying reason It was very clear from the history, that behavior, attitude, progress of a person depend on following two things. Physical capabilities got by birth (Healthy body). Environmental situations. (Natural Conditions) In the above two things, physical capabilities are of less important if environment is good. And if environment is good, then whatever the drawbacks of physical capabilities may be eliminated permanently in future. In simple the only one factor that determines the person is 'ENVIRONMENT'. The best weapon in the world is ?law? as per my knowledge. I never find a weapon more powerful than law. Generally laws are expected to identify specific mistake with higher materiality and do the needful. For example if a missile has been released from a fighter plane, it will destroy things in a specific area. If innocent people are also in that area, then even innocents will be destroyed. If we place advanced law in such area instead of missile, then it may not hurt innocents. Laws are made to get environment in to a controlled position. An environment may be called as ?in controlled position? only if each and every person is getting what they deserve. If each and every person is getting what they deserve, then it may be called as 'virtue'.

Hope everyone will agree that each and every person character was made by the situations in which they have been grownup. If negative issues are becoming more powerful, it may mean that law was losing its controls over situation. As per my understanding constitutions are aiming at controlling situations in a particular geographical locations. In my opinion constitution of India is not an exception. Reason being as below. Article 12 of the constitution is specifies as below

12. In this Part, unless the context otherwise requires, ?the State?? includes the Government and Parliament of India and the Government and the Legislature of each of the States and all local or other authorities within the territory of India or under the control of the Government of India. And clause (2) of article 13 specifies as below (2) The State shall not make any law which takes away or abridges the rights conferred by this Part and any law made in contravention of this clause shall, to the extent of the contravention, be void.? Both the articles 12 and 13 are inserted in Part III, hence meaning for interpreting sub clause 3 of article 13, one need to depend on article 12. As per my understanding meaning of word 'state' means situation with reference to article 12. In my opinion laws will fail if they are not changing according to the situations. If laws are failed then history will repeat.

Classification

As per my understanding, by nature all living being are having four kinds function groups always. Which are as follows. Rulers Facilitators Abiders/followers I believe even in case of animals (excluding humans), the above categories of functions are going on. However one more function is happening in case of humans. And it was the thing segregating us from humans from animals. Humans are able to increase their capabilities by using resources available. Increase in capabilities does not mean only technological advancements, but capabilities to create environment which allows build technological advancements. These function group may be called as 'Guiders'. And Guiders function segregates humans from rest of the animals. When any of positions are failed to do their function properly, and not countered by other functions, then it may lead to 5th function. Such 5th function group may be called as ?traitors?. Any country in the world will consist of all these five kinds of people. If these kinds people are not recognized properly, then it may not be possible to achieve proper environment. For better understanding one may need to understand about '5th Class' and other four function groups.

5th Class

These are people who will not function as any of the other four functions, but they will survive in the mask of one of the other four functions. They are surviving among and beside the other four functions peoples. When more importance have been given to material things instead of their four functional roles, then these kind of group may increase.

For simple understanding these 5th class may be further classified as below

5th Class Rulers:

Who will survive in the mask of ruler. They will not follow functions of rulers although they appear otherwise.

5th Class Facilitators:

Who will survive in the mask of facilitators. They will not follow functions of facilitators although they appear otherwise. 5th Class Abiders/Followers: Who will survive in the mask of abiders/followers. They will not follow functions of abiders/followers although they appear otherwise.

5th Class Guiders:

Who will survive in the mask of guiders. They will not follow functions of guiders although they appear otherwise. Other four functions These four functions are completely interrelated to each other and are equally important. Aim of Rulers, Guiders and Facilitators is to create best capable to humans in future. Abiders/Followers are the humans who are willing to become more capable in future by abiding/following Rulers, guiders and facilitators. Facilitators are the group intended to create facilitates for day to day needs of guiders, rulers and abiders/followers. In simple Facilitators may be compared with business people of present world. Profit motive is not an important thing for facilitators, which may be a flaw of present business world. Rulers need to take care whether all the functions viz. Facilitators, Guiders and Abiders/Followers are happening properly. In the present world rulers may be compared with positions ruling country but not the people in the such positions.

In simple soul/position called prime minister may be called as part of ruler, but the person who is in the position of prime minister cannot be capable to consider as part of ruler. Guiders are the persons whose aim is to concentrate on progress of human capabilities. In the present world they may be compared with professionals. However present world professional getting influenced by situations.

Art 13 is the most vital article of the constitution of india but so called 'rulers' right from Nehrus till date misbehaved with the basc structures of the constitution, as if these rulers always assumed they are or ere superior to professionals in thoughts and practise.

 

for example today , one Ramdas Kadam as a legislator in msaharashtra recommends s/124 on the AG of maharashtra as he expressed his private opinion that Maratwaada need to seceed, that means, Kadam thinks AG has to be the skave of the government, that shows legislators as ruling elite do misbehave as if they are the arbitrators on the peoples views of maratwada - marathwada has people r=their views need to be articulated if their facilitators as their representatives as MLAs could not convince the govt to do something good to that part AG is the right person need to advice what is to be done if failed he might say as a private person he said, How a legislator ftry to foist s/124 of IPC on him is the valid question as can raise in any democracy.

 

If AG has to resign if said, what is his role as a court officer is he need to stay put with his right views what as a preofessiional advocate he would have to he need not succumb to the pressure tactics of the state government; he need not have to compromise with the state government which is nothing once its term is over, and if nor=t reelected naturally these legislators just as any citizen is that is all but AG is an advocate and court officer till he retires volunteerinhgly if not till his death he is an advocate and a citizen. That kind of view the writer seems to have high lighted in his piece, 

 

Like  that rolls are there; once one is AG does not mean he becomes a slave of the government. that is the role of AG one needs to note in the state.

i would,l while appreciate his presentation, i like to mention here, people need control these 5 claases if not  high arbitrariness would prevail every where, so people us3ing Art. 13(2) of the constitution  need to use the weapon called 'class action' as J. Mr. William O. Douglas of USSC said, ' The class action is one of his few  'legal remedies' the small  claimant  has against  those who command  the 'statusquo.'.

 

For eg. there is a law of creamy layer reservation used by Bacward or other backward classes after Kerala government passed  the legislation when her chief secretary was summoned by hon SC when Indra shahani case was disposed, under 'contempt of law procveedings' in 1980s, as the hon ct lt her claim for resrvation sought was flawed  once the poor people under OBC/OBC categories naturally get deprived their right for necessary reservation under same law  under which Shahani was given first reservation but at the time of her appeal she is an IAS officer,indeed much better off and in fact she is in the creamy layer and as such she could not get further reservations what she earlier got recruited; but the state  refused to follow the  verdict when under ART.141 it ought to be followed by any; for not following the state committed  contempt of court and after the hon court gave directions to the chief secretary who is ought to follow but he did no , so he committed the contempt of court.

 

see sir, let us see, if 'creany layer' need be given reservation means very Mondal commission based report and law is flawed one as it deprived other 'creamy layers' under different castes ; therefore the constitutional amendment is too flawed one that deserved to declared ultra vires the constitution, thus whole caste based reservations fall flat is it not;

 

in this regard other people of other communitoes lost several opportunities of growth though they were considered to be more meritorious in their achievents, that means losing several years the opportunities from day one of the reservations act definitely entitles them to get liquidated damages under Tort law besides under the constitution when read with Art 13(2), as Art 12 govt and parliament  passed an untenable reservation  constituttional amendment Act  in the context of kerala 'creamy layer ' reservation Act, is it not?

Like that class action is possible over the govt under rule of la, as you rightly said people better go with laws, thanks

If one assumes all groups exluding 5th class as Human body. Professionals are like keep concentrating on problems appearing to followers/abiders while following laws and provide solutions to such problems. Rulers need to be strong on implementing on solutions with the help of facilitators.

In simple human can walk when legs follow instructions of brain and heart pumps purified blood and other parts facilitate to walk with legs.
