Tuition income under which itr?

I am a housewife and take tuitions at home for neighbour children and earn approx 8-10K monthly. So my yearly income is approx 1 to 1.5 lakh yearly through tuitions. Again this is not regular, sometimes its less but never exceed 1.20 or 1.50 lakh. Also I have approx 10K income from saving bank account interest and bank FD intrest. Under all circumstance, every year my total yearly income will never exceed 1.60 Lakh even on including bank/fd intrests. I have few questions for which I need advise on this forum:--

(1) Which ITR form I should use if I am willing to file online ITR? To make my life easy and compliant with all income tax rules, can I use ITR1 and show this tuition income as "income from other resources"?

(2) I also wish to file return for FY12-13 (AY13-14) using ITR1 as per details in question#1. Please suggest can I file using ITR1 with "income from other resources" before 31March2014?

(3) Can I also file return for FY11-12 (AY12-13) before 31Mar14 using ITR1? My total income was around 1.70 Lakh in FY11-12.

Thank you all in advance.

As it is seems that no orher business or profession is done by u u ur tution income is main income and it fall under income from business and profession and u have to file itr 4 U can file it return for ay 12 13 till 31 march 14 without any tax liability

You may file ITR-4.

You may file ITR-4 for the FY 12-13

You may file ITR-4 for the FY 11-12 but with a penalty.

Thanks for responses. I am also running classes for other hobbies like painting, cooking etc. The above income is actually combined for all of them. Even then do I need to file ITR4?

Actually I have seen ITR4, and it is bit difficult. In such scenerio, I will not file income tax return as my income is below 2 lakh per annum. However I wanted to file return regularly to have my ITR history.

Hello,

It is going to fall under the income from other sources

because it will not your business.

because for business you have to reg your self.

so dont treat as business income

it is income from other sources

& itr1 sahaj will applicable.

& you can file your return before 2014 of 31st march

so do it as soon as possible

thanks

I am a salried person but i am not receved any form 16 , now i want to filed ITR which form should be filled. My employer are also not filed itr, its a shop

Even today, there is difference of opinion whether housewives who take home tuition on irregular basis or irregular count of students whether their cash income they received reflect in ITR3 (old ITR4) or ITR1.

There is some information available here but still the ITR form number is not told in this article.

Any further thoughts on this? I do not think housewife irregular home tuition is presumptive income business.

how the occasional home tuition without mandatory fee (whatever is given is accepted as token) by housewife on a very irregular manner or suggesting somebody some homeopathic solutions to some small ailment without any mandatory fee (again whatever is given is accepted as token) and the total income not exceeding 1-1.5 LPA be classified as business or profession. can ITR-1 not be filled in such cases showing it as income from other sources with descripttion as part time home tuition or home solutions to small ailments.

Mr. Sohail, You can file ITR 1 if you do not have any other income source from business or capital gains.
