Hi. I am CA final student & my attempt is in May 2016. I have completed 2 years of articleship. My principal has not allowed me leave & he told me to get termination. He is not ready to give me�a secondment. As I really need to take leave for studies & classes. Is�it allowed to take termination on mutual consent after completion of two years?� What should I do? Please help me guys..

After completion of 1 year, for termination you will be required to seek prior permission of ICAI. There are certain grounds for it, further, one of the ground is residuary ground. You can check the ground on ICAI website. But from my view, if you terminate and join somewhere else, the new firm will not be willing to give you leave.

As per ICAI regulation, you can take leave up to certain extent based on leaves taken till now.. By calculating, your excess leave that can be availed you may take leave to such extent without extension... Else last resort can be extension.
