TDS on property from NRI

I am purchasing a property from a person who is generally an NRI i.e. person of indian origin with Australia citizenship and oci holder.

 

He is saying that he is in india from march 2023 and as he has already completed his 182 days I should deduct tds @ 1%.

 

He is not showing his passport but is ready to give me an affidavit stating that he is resident for this year.

 

 

 

Can I deduct tds @ 1% in this case.

 

If in future I receive notice from department that tds should have been deducted as a nri then will this affidavit help me in removing the demand from department?
