Tds on internet charges

      Dear All,

              I have a Bill of TULIP TELECOM LTD.  it is regarding to internet charges ( leaseline connection ) ...... the company deduct TDS on every bill of TULIP TELECOM LTD @ 2% u.s 194 c....

          but TDS will not deduct on standerd facilities......so what shud i do..

         shud i deduct TDS for next bill nd continue OR

        shud i stop to deducting TDS from next bill. ???

As per law if it is not required than why deduct, You should stop deducting TDS.

In the recent case law it was held that internet services do not involve human effort as per the provisions of the act ... fees for technical services should involve the human elements .............

so no tds on telephone internet charges ....

please find herewith the supremet court judgement
