Sir, Kindly advice the course of action regarding TDS not fully claimed from salary income, on the following facts:

1. I.T.Return, declaring income of Rs.1291368/- from salary and other sources income Rs.41814/- totaling to Rs.1333182/- and after deductions u/s Chapter-VIA of IT Act 1961, amounting to Rs.120000/-and thus net income was Rs.1213180/-, was e-filled on 28/03/2012, claiming a refund of Rs.45990/-.

2. Total tax payable on Rs.1213180/- was Rs.224493/- and TDS claimed was Rs.270483/- and refund claimed was Rs.45990/-. The assessee has received the refund of Rs.48060/-.

But the total TDS in Form-26AS was Rs.333960/- whereas TDS wrongly claimed in IT return was Rs.270683/-. Thus short claim of TDS of Rs.63277/- in the IT return filled.

Now, how the assessee can claim the refund for the balance TDS portion i:e for Rs 63277/- not claimed in the IT return filled ??

Dear Hari Pal,

What I think is assessee shall file revised return to  claim the full TDS.

Revised return can be filed before completion of assessment. In your case assessment has been completed as you have received refund and hence you cannot file a revise return. A letter to concerned officer alongwith tds certificates which havent been claimed, and the original return shall be sufficient for officer to release the balance refund amount. plz wait for an expert advice and guide me if wrong.
