TDS not deducted

hello,
my brother is working in MNC,last year he switched his job during the last 2 months of financial year ..so the later company has paid salary of Rs.2 lacs for last 2-3 month approx and has not deducted tds and has not even issued form 16 so will be correct if I don't show that salary in the return.
if I don't show the income in the return what will be the further consequences he will have to face apart from interest.

You must show that salary in your return and pay Self assessment tax on it even if the employer doesnt deduct tds or give you form 16. 

If you dont show that income in tour return then it would amount to under reporting of income and tax evasionary fir which apart from paying the related tax and interest , you may face penal consequences also.

You have to pay taxes as per total income now under SAT 300

Is he currently employed in another company ?

Section 192 - T D S on payment of Salary Ref:- C B D T Circular 11/2006 ( T D S in case of change in employment ) The tax so paid by the employer shall be deemed to be T D S made from the salary of the employee. Salary from More Than One Employer: 3.4 Sub-section (2) of section 192 deals with situations where an individual is working under more than one employer or has changed from one employer to another. It provides for deduction of tax at source by such employer (as the tax payer may choose) from the aggregate salary of the employee who is or has been in receipt of salary from more than one employer. The employee is now required to furnish to the present/chosen employer details of the income under the head "Salaries" due or received from the former/ other employer and also tax deducted at source there from, in writing and duly verified by him and by the former/other employer. The present/ chosen employer will be required to deduct tax at source on the aggregate amount of salary (including salary received from the former or other employer). Where the employee during the year has changed from one employer to another the circular provides for deduction of tax at source by such employer (as the taxpayer may choose) from the aggregate salary of the employee who is or has been in receipt of salary from more than one employer. The employee is now required to furnish to the present/chosen employer details of the income under the head ‘salaries’ due or received from the former/other employer and also tax deducted at source there from, in writing and duly verified by him and by the former/other employer. The present/chosen employer will be required to deduct tax at source on the aggregate amount of salary (including salary received from the former or other employer).
No currently he is not employed there , as he has started his business.

Its not easy to evade taxes now on as the salary credited in his bank account..

better to make some tax free investments and reduce the taxes.
