I have not deducted TDS on the job work payments I made to the job work units in assessment year 2012-2013. In random selection, my account was taken by Income tax department and during the enquiry, they asked me, why TDS not deducted. I told, it was a small company and poor company and so I didn't deduct that and it is under a Trust. They didn't agree with me and and I felt , they may put penalty. Already my company is in a bad situation. I got a reply from a friend in this page and what he wrote is correct. But unfortunately, the Trust is filling the returns lately and I am not able to tell the officer to ask the IT from the Trust. I am worried and praying for soloution to come out of it. Also do I deduct TDS on buying fabrics ? Do I detuct TDS on advertising ? Please guide me

you must have deduct the tds now you request to income tax officer that no penalty apply and i have paid the tax. you are checked that the opposite party had filed the income tax return or not. if they filed income tax return there is no loss of revenu. i have not deduct the tax but it is paid by opposite party. now i have became regular and deduct the tax. you ask opposite party return and lettter to assessing officer that there is no loss of revenu because the opposite party had paid the tax. and also request no penalty apply.
