Sir,

One of our main contractor deducted TDS from our bills for the financial year 2009-10, and he has not yet issued the TDS certificate, last year he had deducted the TDS and the certificate issued only on sepetember after continuios follow ups as he deposited the tax only on septemeber 2009 for which he deducetd during Feb2008, and now for the final settlement we have asked the tdscertificate  for this financial year so that we can give him a no claim certificate but he refused to give and he answerd is that

 " We have / will deposit the TDS deducted & file the return as per the TDS rules. We will send you only one TDS certificate for all  transactions made during the complete finanacial year at the end of the year as per the govt. norms in place" 

to avoid future problem how can we get an assurance that he has deducted and deposited the tax properly and if he is not giving TDS certificate how we can claim for it?

as he is not a good contractor and we are struggling to get the payment we do not have trust on him..

so kindly send us the information to resolve this issue.

Ask him to provide you a copy of the chalan by which he has deposited the tax with the authorities as he has to pay it to the Government by the 7th day of the month following the month in which he has deducted the tax.
