Quick Summary
This discussion addresses the correct Income Tax Return (ITR) form for individuals with income from various sources, including a small business not covered by Section 44AD, and who are eligible for nil filing. The advice clarifies that insurance agency income, often involving brokerage or commission, is not suitable for presumptive taxation under Section 44AD. Depending on the regularity and nature of the income, filing ITR 3 for business income or ITR 1 for income from other sources (or ITR 2 if capital gains are involved) is recommended.
A person can not file return u/s 44AD for income of brokerage, Commission and any agency business..So, 44AD is not applicable.
If your Insurance agency income is Regular and also going to be increase/ continue in future years also, than its considered as business income and you can file ITR 3
But it's irregular and small in amount as compared to your other head income than you can consider that income as income from other sources and file ITR 1. (ITR 2 if also have any Capital Gain)
