My self is Adithya (Cleared CA FInal in Nov 2011). I have a query regarding employer's liability u/s 192 of the IT Act. Whether the verdict given by the supreme court in L& T Case that employer is not obliged to examine the evidence submitted by the employees in respect of LTA and Conveyance allowance is applicable to other exemptions claimed by the employees without submitting the evidence and just giving the declaration to the employer.
In short whether employer is safe by merely collecting declarations from employees for the purpose of tax deduction U/s 192 without examining the underlying evidence ?.
