Dear Friends,

Can a person who is not an auditor/ca file E FileReturn with the ROC the respective forms(Form 20 B, 23ACA , 23 CA) for a private limited company having a paid up capital (more than 10 Lakhs and Less then 1 Crore).

Kindly guide.

DSC(Digital Signature) of CA is required to certify the attachments.

These forms need to be signed by a director or co. secretary - on co.'s behlaf, as per the res. passed.

furhter they should be approved and signed by a practicing CA/CS/cost acct., with the details like the associate or fellow member with memb.no.

hence, if one falls under any of the above categories, may sign either on co.'s behalf or as an approving authority.

That means that a CA is compulsory for E Filing of the respective forms to the ROC apart from finalisation of the balance sheet.

Yes, DSC of CA is mandatory.

Thanks for the above information. One last question . Can any director of a company file the ROC E filing through his Digital Signature ? If not, then apart from CA who else can mandate the forms?

Any director(whose DSC is registered with ROC) can sign the return, and apart from CA in whole time practise, any CS or CWA in whole time practise can sign the form.

I am a director in a private limited firm and have to file Form 20B and other forms to the ROC through E Filing. I have a DSC. Can I fill the return on my own.

No you cant file Form 20B on your own .It must be certified by a CA,CS,CWA by digitally signing  the doc.

No.. Ca's Digital Signature is required..

so not possible...
