Return of imported goods

Dear All,
 
I want some clarification regarding Import Shipment, We have imported some goods by paying custom duty, Now we want to return the same goods to the same supplier because of we are not able to use that product. So my question is :-
 
1. Is there any specific documentation or procedure to return the goods ?
2. Is there any period in which returning can be possible?
3. Can we take back our duty amount that we have paid while importing?

If you have endorsed the Model number and serial number of the goods in the Bill of Entry, then you can export the same back without much issue and claim drawback under sec 74.

there is no time frame for export back but your drawback  amount get reduced proportinately.

 

All import documents, Bill of entry, TR- 6 challans and report from your quality engineer for rejection of goods, correspondence with supplier that they are ready to accept the goods back and refund amount, if value of goods are already remitted.

Further we haven't transfer funds to our supplier. But is it possible, that we will take GR Waiver for Custom duty amount and return these goods to supplier and after that we import another goods on the GR Waiver to save custom duty.

First of GR waiver is Guranteed remittence waiver, the is forwaiver of Export proceeds not for customs duty. You have two options.

1. Export the goods back , you need to get GR from bank, claim duty paid under sec 74 and import fresh goods and pay applicable customs duty

 

2. you export the goods for repair, get it repaired  and on imports back, you need to pay customs duty on two and fro freight and repair charges.

 

In both cases there are no issues.
