Resignation of a Director

A Director (Mr. A) resigned from directorship of the company and DIR-11/12 was duky filed by the company.

Later, Mr. A alleges that he did not resign from the company, and that his DSC was misused. Mr. A applies to NCLT.

how can the company contend that the resignation was wilful and no fraud was involved?

Yes, he did submit a letter of resignation by hand.
He is now denying the same and alleging that the resignation letter was forged by other directors.
If the person claims that the resignation letter was forged, help of hand writing expert can be taken in this regard to prove the authenticity.
