My company has a construction project In Chennai, we need import some equipments used for the construction, the constructee has deducted the VAT, can we refund or exempt the SAD, if not , we find a agency import the equipments for us, can the agency refund the SAD?

the importer of the said goods shall pay all duties, including the said additional duty of customs leviable thereon, as applicable, at the time of importation of the goods

please noted that if you paid SAD through the import which is mentioned on bill of entry then can refund .
