Hi,

 

We are a paper manufacturer.

 

We are getting machinery from China. We have to send bearings to the machinery manufacturer in China so that he can fit the same into the machine.

 

The bearings will be purchased by us locally. 

 

Please let me know as to which notification will cover the re-import of the bearings without attracting duty on the bearings. There will be duty on the machinery supplied by the Chinese manufacturer. Will it be notification no. 94/96?

 

Also, can we make the invoice for the said bearings in the name of the Chinese manufacturer? Also, is it to be mentioned on the invoice that the goods are going to be re-imported?

At the time of Import, can you prove that these are the same bearings*xported earlier ?

You can have a look at the attachement containing details under Chapter 19 of Custom Manual 2012.

Chapter 19 talks of ReImport and ReExport.

The bearings can be proved to be the same which were exported.

I had already read the said chapter and could not find clarity on my particular issue.

Hi,

The process goes as under-

To Export Bearings out of India to China Supplier
A. Pls make an Invoice alongwith Packing list
B. Clearly mention the bearing identification No
C. Declare on Invoice itself that
 1. these bearings are to check fitment only and not for commercial purpose.
 2. That these bearings will come back
 3. That amount shown in Invoice is for Custom Purpose only and not chargeable to China Supplier.
D. Show these bearings in Shipping bill with a word "Identification No" and write ID nos is shipping bill.
 
 
While Re importing
A. China will make a Inv and PL for these bearings with same value
B. China will write that these are being returned after fitment test.
C. Pls do not mix this inv with that of Main Machine
D. At India Customs - Pls have these Bearing ID mentioned in BE
E. Attach supports of Inv, PL, SB raised at the time of sending the bearings
 
This was you van avoid the payment of Custom duty while reimporting. Also China will not pay any custom duty at the time of taking bearings.
