Hi, I am a proprietor of a shop. I also get salary of Rs. 15000/- for my part time job. From my salary Professional tax of Rs. 2500 p.a. is deducted by employer. Now whether is should pay PT for my proprietory concern as a proprietor or i should not pay as i have already paid it while getting salary income.

If you are in state of maharashtra , then from next year onwards i.e after you recieve your salary for February month , tell employer not to deduct profession tax. Give him a declaration in the format available online on mahavat website which states that you are paying profession tax under your own proprietor ptec number so not to deduct tax. So then from next year , you need to pay the tax online by 30th June against your own Ptec number.

Thank you.

Can you send me the link from where I can get the declaration format.

Thanks in advance.

Also the case is that my employer has already deducted my PT for the whole year and also paid it & filled the return few days back. Now can he claim refund and repay me back my PT amount.

One more doubt is that how will the employer show that he pays me the salary but doesnt deduct PT from my salary, in his PT return ?

Waiting for your reply.

Since the employer has already paid the profession tax and filed return , it is not advisable to claim refund from govt and pay the pt amount back to you.
He will not report you as employee under the profession tax return. He will only report other employees whose pt is deducted.
Please download form 2B under profession tax for your purpose.
You will also need to provide copy of your Ptec regidtration Certificate to employer along with form 2B
